EFIKATO respects and values everyone's privacy. For this reason, it has prepared this Privacy Policy to demonstrate its commitment to protecting Privacy and Personal Data, in accordance with the applicable data protection legislation (General Data Protection Law – Law No. 13,709 of August 14, 2018, also known as LGPD).
To help strengthen our commitment, we have developed this Privacy Policy to help you better understand the types of information we collect, why we collect it, how we use it, and the various options you have for managing the privacy of your personal information.
SCOPE OF THIS PRIVACY POLICY
This Privacy Policy describes our privacy practices for information we collect from or about individuals located in Brazil through our services, websites, products, mobile applications, desktop applications, or software intended for Brazil (collectively, “Services”) and other initiatives intended for Brazil, such as marketing, events, and product training.
Efikato as Data Controller
Efikato is a company that provides services to other companies. We do not provide services to individuals.
This Privacy Policy applies only in situations where we process personal information about you, as an interested individual. In this case, Efikato will be the Controller of your data.
When we process your personal information, Efikato is considered, under LGPD, the controller of your personal data. If you wish to know more about the processing of your personal data, please contact Efikato's Data Protection Officer. Your contact details are in the “Contact” section.
Efikato as Data Operator
When Efikato, during the provision of its services, has access to personal data collected by its client (Data Controller), it will be acting as a Data Operator. In this way, it will follow the Data Privacy Policy of the Data Controller (Efikato's client).
Efikato adopts practices based on data security and privacy standards. We are constantly concerned with ensuring that the provision of contracted services offers total security, privacy, and confidentiality to its clients.
1. WHAT INFORMATION DO WE COLLECT
Information you provide to us.
Accessing our website. We receive information when you use our Services, such as information about your business, invoices, and financial statements.
We may also collect additional information when you contract or otherwise use our Services.
Our privacy policy applies to content published on our website. The EFIKATO website may contain links to other websites. Therefore, if you click on a link to another website, we recommend reading that site's privacy policy.
Customer Support, Product Research, Training, Events, and Feedback. When you contact us for support, give us feedback, participate in optional surveys, product research, events, or training, we may also collect the information you choose to share.
Information we obtain when you access the Efikato website
The Efikato website uses Google Analytics to analyze access and obtain information about the pages and content that interest you most.
The purpose of using Google Analytics on the Efikato website is to offer services that are increasingly closer to the needs and interests of its clients.

What is configured in Google Analytics:
Data Retention: Google Analytics is configured for data retention for 26 months.
Remarketing: This feature is not enabled in Google Analytics for the Efikato website.
Usage Information. We may collect usage information, such as the pages you viewed, the tools you used, your browser type, error reports, and any links you clicked to leave or interact with our Services. We may also collect information about other applications you use on your device for analytics and advertising purposes.
Location Information. Certain features of the Services may collect your precise location data, device motion data, or both, if you grant permission to do so in your device settings.
Information about Cookies and other technologies. Efikato does not use “Cookies” to collect visitor data from its website. However, due to the use of Google Analytics, it stores Cookies on Efikato's website to recognize your visit, identify your interactions with our site, and improve your experience and that of other customers.
You have control over what data we collect and how we use it. For more information, see Section 4, “What you can do to manage your privacy”.
About obtaining data about you from Third Parties
Efikato does not collect or obtain data about you from Third Parties.
Whenever any data or information about you that we do not have is needed, Efikato will make a request to you, which you may or may not authorize.
Required Information
Some of the Services provided by Efikato may require you to provide certain data to correctly and fully use the Services. If you do not wish to provide the necessary information, you may not be able to use certain functionalities or even the Services as a whole. We will inform you about which information is necessary and which information is optional. We may also associate the information you have provided us with information we have obtained about you from other sources, always in accordance with applicable law.
2. HOW WE USE YOUR INFORMATION
We use your information to:
Provide, Improve, Protect, and Deliver the Services. To provide you with the Services you accessed or contracted; to personalize your experience; to provide technical support; to protect the security of the Services, our customers, Efikato, and others; or to operate our business.

From time to time, we may communicate with you, including to: provide you with important information about the Services; offer you third-party products or services that we believe may be of interest to you; send you information about Efikato, such as other Efikato products and services, special offers, and new service or product launches.
Protect Efikato and Others. To protect Efikato, our customers, and others, such as for fraud prevention purposes.

We may use both manual and automated systems to: analyze your information to improve our Services; personalize your experience; automate certain aspects of the Services; provide you with certain functionalities; and protect the security of Efikato, our Services, our customers, and others.
We will use the personal information we collect from you only for the purposes described in this Privacy Policy or for purposes we provide at the time we collect your personal information.
We may use your personal information for other purposes, provided they are not incompatible with the purposes permitted by applicable law and provided we have your consent.
We will provide additional information about any further processing activities when they occur, in accordance with applicable data protection laws.
3. ABOUT SHARING YOUR INFORMATION
Efikato uses software tools for data management.
Therefore, your personal data is stored in the following applications:
Gmail Contacts (Google): your contact details: Full Name, Company Name you represent (if applicable), Area of activity or service you perform, email, and contact phone numbers.
We use GMail to receive and send messages and documents via email.
Hubspot: your contact details: Full Name, Company Name you represent (if applicable), your relationship with David Yoshida or Efikato, email.
We use Hubspot to send information via email that may be of interest to you. If you do not wish to be part of the interest list, you can unsubscribe from the respective list at any time and stop receiving messages related to that contact list.
With your consent.
Efikato does not have Affiliates or Subsidiaries.
We do not share your data with other Efikato clients.
We do not share your personal data with Social Media Platforms.
Should Efikato be interested in publishing your personal data or image on any social network, Efikato will send a request for authorization to use this data and/or image pertaining to you. You may authorize or not the publication of this data and/or image.
4. WHAT YOU CAN DO TO MANAGE YOUR PRIVACY
You have choices when it comes to managing the privacy of your personal information.
Manage our company's marketing communications. We honor your choices regarding receiving our marketing communications. To update your preferences (including opting in or out of marketing communications), you can send a request via email to Efikato's Data Protection Officer, whose contact details are in this document. You can also click the link in the message you received to unsubscribe from marketing emails.
We do not use Cookies and other tracking technologies.
5. DATA STORAGE
Unless you make an express request for us to delete your personal information, as explained in Section 6 “Your Rights”, we will store your information for as long as necessary to provide you with our Services. Once your contract has ended, or you otherwise stop using our Services, we will no longer store your information, except when necessary:
If we no longer need your information for the aforementioned purposes, such information will be deleted or anonymized, in accordance with our data retention policies.
However, there may be occasions when we cannot completely delete or anonymize your information due to technical or other operational reasons, for example, when your information has been archived in backup systems.
When this is the case, we will take reasonable steps to securely isolate your information from any further processing until we are able to completely delete or anonymize it.
6. YOUR RIGHTS
In accordance with the General Data Protection Law (“LGPD”), you have the right to request access, rectification, portability, deletion, and confirmation that we process your data. In certain circumstances, you also have the right to object to and restrict the processing of your personal data, as well as you may withdraw your consent when we process the data you have provided us based on your consent. To exercise any of your rights, please contact us through the contact channel provided in Section 10, “How to contact us”.
Access, Correction, or Deletion. You may request access to, correction of, or deletion of your personal data. Often, you can directly access the Service, in the Account Settings option to take these actions. Please note that even if you request the deletion of your personal information, certain aspects may be retained so that we can comply with legal or regulatory obligations (for example, keeping records of transactions you have made with us), for the regular exercise of our rights, including in contract and in judicial, administrative, and arbitration proceedings, and to protect ourselves against fraudulent or abusive activities in our Services. Data retained for these purposes will be processed as described in Section 5 “Data Retention”.
Objection and Restriction. You may object to or request that the processing activities of your personal data be restricted.
Portability. You may request the portability of your personal information, subject to trade and industrial secrets.
Withdraw Your Consent. If we have collected and processed your personal data with your consent, you may withdraw your consent at any time. 7. THIRD-PARTY SERVICES, LINKS, AND INTEGRATIONS
Third-Party Services. Third-party products, services, and applications may use or integrate with our Services, or be offered through our Services (“Third-Party Services”).
For example, we advise our clients on creating accounts in applications such as Google Apps (Gmail, Spreadsheets, Docs, Calendar) and Trello.
By contracting Efikato's services, you allow Efikato to provide your information and any information associated with your account, including personal data, to these third parties. Your interactions with these Third-Party Services are governed by the privacy policy of the company that provides the Third-Party Services.
8. SECURITY OF YOUR INFORMATION
We understand that the security of your information is important to you. We adopt technical and administrative security measures to protect your personal data. Even with our best efforts, we cannot assure or guarantee the security of your information. 9. INTERNATIONAL DATA TRANSFERS
We will not transfer or store your personal information in other countries.
Exceptionally, should this situation become possible, we will contact you to request clarification and your authorization for the transfer.

11. CHANGES TO OUR PRIVACY POLICIES
From time to time, we may change or update our Privacy Policy. We reserve the right to make changes or updates at any time. 12. COLLECTION AND USE OF PERSONAL INFORMATION OF CHILDREN
Our services are intended for and directed to individuals 18 years of age or older, and we do not intentionally collect personal information from minors.
13. GENERAL INFORMATION AND DEFINITIONS
- LGPD. General Data Protection Law (Law 13.709/of August 14, 2018). This Law provides for the processing of personal data, including in digital media, by natural persons or legal entities under public or private law, with the aim of protecting the fundamental rights of freedom and privacy and the free development of the personality of the natural person. From this point forward, in this document, this law will be referred to as LGPD.
- User. All natural or legal persons who access/visit the website (www.efikato.com.br). Natural persons may also be identified in this Privacy Policy as “Data Subject”, as provided for in the LGPD.
- Personal Data. Any information provided by the user when filling out the contact form that: (i) Identifies an individual, either alone or when used in conjunction with other information; (ii) identifies the contact information of a natural person. Personal Data does not include generic business contacts, such as commercial emails or phone numbers (@company) that do not identify an individual. The LGPD does not protect the data of legal entities.
- Sensitive Personal Data. These are data whose processing may lead to discrimination of their data subject, such as, for example, data related to religion, sexual or gender orientation, philosophical or moral beliefs, associations and unions, and political opinions. We do not collect Sensitive Personal Data.
- Cookies. These are small files that are stored on the user's computer through the browser, containing information related to their preferences during navigation on a website. It is not possible to identify a person solely through cookies. However, they may allow tracking of your visits to websites. We do not use cookies on our site.
- ANPD. National Data Protection Authority. Regulatory body for the application of the LGPD.
- Legal Bases defined in the LGPD and used in EFIKATO:
- Purpose. The purpose of EFIKATO in processing the Data, including Personal Data.
- Necessity. The reason, the justification why it becomes necessary to collect the data, including Personal Data, achieving the Purpose and avoiding any excessive collection.
